Administrative License Suspension Proceeding
(This Occurs at the State level and not at the local court level)
The ALS hearing is triggered either by your refusal to submit to the "state-administered" blood, breath, or urine tests or, after you submitted to such tests, your blood-alcohol level is .080 or greater.
You MUST request a hearing through the Georgia Department of Public Safety - Department of Driver Services within ten days of the arrest or your license will be automatically suspended by the State for 12 months.
Once you have requested a hearing in writing, a hearing will be scheduled before an Administrative Law Judge of the Office of State Administrative Hearings (OSAH) - this usually takes about 2 months from the date of arrest.
One court facility is designated in each county to host he ALS hearing and may or may not be the same court in which you are charged.
