Why the Urgency?

Your driving privileges will be suspended for 12 months if you do not request a hearing in writing within 10 days of your arrest.


Does the 10 Day Deadline apply to me?

IF your Blood Alcohol Content GREATER THAN .080 or you REFUSED to take a blood, breath, or urine test, you need to request a hearing immediately.


How do I Know?

Your DUI ticket (Uniform Traffic Citation)  should state whether or not you refused the test or, if you took the test, the ticket should list your blood alcohol content.

The arresting officer should have given you a yellow 8 1/2" by 11" document called the DPS FORM 1205.  Look in the Lower left hand corner of the document to find the form number. 

Even if you did not receive this document, you should still request a hearing within 10 days of arrest.
